Mawhiney Convicted of Attempted 1st Degree Murder

Sentencing is set for February for a Deposit man who shot and wounded a New York State Trooper who had responded to a call to check on a despondent person in June.

A Broome County jury deliberated about eight hours Friday, November 19, before finding 44-year-old Scott Mawhiney guilty of attempted first degree murder, aggravated criminal possession of a weapon and harassment.

Trooper Ryan Thorp was wounded in the arm and is still suffering medical complications after being shot June 23 when he responded to a domestic complaint at Sunrise Terrace in Deposit.

The defense claimed Malwiney was not himself that night, having taken anti-anxiety medication and consuming alcohol after having "a hard day at work."

Over the course of the trial that began with jury selection Monday, November 15, the prosecution argued the Deposit man knew what he was doing and that it was wrong before firing at responding officers with a 20-gage shotgun.

The charge of intentionally attempting to kill a law enforcement office carries a possible sentence of up to 20 years to life in prison.
