New York’s Stun Gun Ban is Unconstitutional
New Yorkers have a Constitutional right to own a stun gun.
That's the ruling by a Federal District Judge. The Associated Press reports the ruling came March 22 in Federal Court in Utica after Matthew Avitabile filed a lawsuit challenging New York State's ban on civilian Tazer devices.
Avitabile said he wanted to buy a stun gun for self-defense. His lawyers said the longstanding ban on civilian ownership of the weapons is a violation of the Second Amendment right to bear arms.
The ruling comes on the heels of the Illinois Supreme Court's similar ruling March 21 and Massachusetts' courts striking down The Bay State ban in 2018.
