Michael Korchak's victory in the Broome County district attorney's race now may be certified after a judge denied a request for a recount.

Korchak, who ran as the Libertarian Party candidate, was ahead of Republican Paul Battisti by 55 votes following the count of absentee and affidavit ballots.

Battisti went to court seeking a full hand recount of the vote. State Supreme Court Judge Richard Rich Jr. Tuesday rejected Battisti's request.

The judge's decision clears the way for the certification of the voting results by the Broome County Board of Elections.

Korchak has been the chief assistant district attorney for nearly four years. He ran on the Libertarian Party line after Battisti defeated him in a close race for the Republican nomination last June.

Korchak and Battisti could not be reached immediately to comment on the court ruling.

Debra Gelson, who ran as the Democratic candidate for district attorney, Tuesday afternoon congratulated Korchak and wished him well in implementing the state criminal justice reforms that go into effect next month.
