A Binghamton man, who had a prior rape conviction on his record, is headed to prison for choking an 18-year-old during a domestic incident earlier this year.

The Broome County District Attorney says 24-year-old Derek McNeil will serve five years in New York State prison for injuring the girl on March 30th at a home on Homer Street.

McNeil was sentenced in Broome County Court September 27 after pleading guilty to the felony charge of Assault in the Second Degree and Criminal Mischief in the Third Degree.

Police responded to the home with a report of an argument that turned physical and found the 18-year-od female had suffered an injury in the incident.

At the time of his arrest in March, McNeil had initially been charged with Assault, Criminal Contempt in the First Degree and Criminal Obstruction of Breathing or Blood Circulation.

Prior to that March 30 incident, District Attorney Michael Korchak says, McNeil had been convicted of felony Rape in the Second Degree.

According to a June 2, 2022 news release from the Broome County Sheriff’s office, while confined at the Broome County Correctional Facility in the Town of Dickinson on the Assault, Contempt and Obstruction of Breathing charges on March 30, “inmate Derek McNeil punched a glass window in the door leading out of the housing unit recreation yard breaking it.” Authorities put the cost of that damage at $250.

The Binghamton man was charged with Criminal Mischief in the 3rd Degree, which is a felony, for the jail incident.

McNeil had been convicted January 21, 2021 of Rape in the second degree.

During the September 27 sentencing in Broome County Court, McNeil has also been ordered to serve five years post-release supervision after he gets out of prison.
