The New York State Police now report a pedestrian that was hit by a car August 9 near the Unadilla Valley Sports Center has died.

Troopers say 20-year-old Jonathan Mayzak of Murrells Inlet, South Carolina, succumbed to his injuries August 11 shortly after 1:30 p.m.

An autopsy is to  be performed at the Onondaga County Medical Examiner's Office in the near future.The statement from the State Police says: "the investigation is continuing with the New York State Police Collision Reconstruction Unit and State Police in Norwich.  The Chenango County District Attorney's Office will be consulted at the conclusion of the investigation as to whether additional charges are warranted."    

31-year-old Edward Burnett of Utica is currently charged with two counts of felony driving while ability impaired with a child under the age of 15 in the vehicle in connection with the incident.

Burnett is accused of hitting the pedestrian on State Route 8 in the Town of Columbus at 8:53 p.m.

Troopers say they were working a detail at the Motorcross when they were notified of a pedestrian hit and found Mayzak on the shoulder of State Route 8.  An off-duty Sidney Police Officer was on the scene tending to the victim and troopers assisted until paramedics arrived.

Authorities say Burnett showed signs of impairment.  He had a 30-year-old woman in the vehicle along with an 8-year-old and 4-year-old child.

In addition to DWAI, Burnett is charged with vehicular assault.

He was sent to the Chenango County Jail on $100,000 bail.
