The 55-year-old Town of Spencer resident was ordered to participate in anger management counseling as part of a conditional discharge. He also was ordered to pay $225 in fines and surcharges.

Acting village justice Lynn Craig issued an order of protection for Thomas Zikuski, who was involved in a confrontation with Harris in March 2015.

Harris was directed to have no contact with Zikuski, who is a brother of Binghamton Police Chief Joseph Zikuski.

In addition to the sentence, Craig directed Harris to remove her image from his Facebook page. Harris said he would do that, along with taking down the judge's picture he had posted on his other social media accounts.

Craig had convicted Harris of second-degree harassment following a non-jury trial on August 11.

The verbal dispute between Harris and Zikuski occurred after a SUNY Broome history class that was held at a Tioga County office building.

Cayla Harris, who was in the class, became upset when Zikuski mentioned her father's murder trial during a discussion.

Harris showed up outside the building a short time later and the men had a heated profanity-filled exchange of words. But, according to testimony during the trial, no shoving or hitting occurred.

Assistant District Attorney Cheryl Mancini, who had prosecuted the case, had asked the judge to sentence Harris to ten days in jail. She maintained Harris had made a choice "to lay in wait" to confront Zikuski after the class ended.

Tioga County District Attorney Kirk Martin declined to comment on the sentence other than to note the decision against jail time was within the judge's purview.

Harris could have been sentenced to 15 days in jail and a $250 fine for the harassment conviction.

Harris said he intends to appeal the Owego conviction. In May, Harris was acquitted of murder in a non-jury trial in Schoharie County.
