A Cortland County man will be sentenced September 13 for felony aggravated vehicular homicide for a crash that killed his 6 year old daughter last year.

30 year old Daniel Haynes III of Virgil pleaded guilty in Cortland County Court in connection with the crash that killed the child and injured his 8 and 10 year old daughters as well as two adults on April 24, 2015 on West State Road in Virgil.

Police say Haynes was driving at over 100 miles an hour and none of the children was wearing a seat belt when his car smashed into a utility pole.

Sheriff’s Deputies said Haynes and the adult passengers had been drinking at the Haynes home and were planning to take the children to a babysitter for the evening.

One of the passengers said they believed Haynes had had a couple of beers but prosecutors say at the time of the crash his blood alcohol level was measured at point-one-six percent, twice the legal limit.

Haynes had a previous drunk driving conviction from 2007.

He could face 10 to 20 years in prison but is free to await his sentencing.
