A demonstrator protesting the use of non-union workers at the construction site of the Dicks Sporting Goods distribution center in Conklin is recovering from a wrist injury after being hit by a dump truck.

New York State Police say the protestor was hit at around 7:30 a.m. September 7 and Troopers said the driver was not to blame.

Union leaders disagree and say the man was hit on purpose.

Operating Business Union members are claiming the contractor is failing to pay prevailing wage on the project as negotiated by the unions.

Authorities had received complaints from the jobsite of demonstrators blocking the entrance.

The $100 million distribution center is expected to employ over 400 people once it is completed.
