The Binghamton Press and Sun Bulletin reports a Tioga County man is under a new indictment on two second-degree murder charges in connection with the death of his 8-month-old daughter whose body was found in a pond behind Saint Patrick’s Cemetery in the Town of Tioga in June.

25-year-old Cody Francisovich is accused of acting with depraved indifference in the murder of Ruby on June 9.

Franciscovich had initially been charged with first degree murder, accused of raping the baby, but he had not actually been charged with a sex crime.

Tioga County Emergency Services officials were contacted at 7:10 a.m. on June 9 to check on the welfare of the child and her father in a call placed by the baby’s mother from the Deep Well Motel on Route 17C where the family had been staying.

Authorities found Cody Franciscovich naked along the road and the man told troopers where to find his daughter.  Ruby was found face-down in the pond.

Franciscovich has pleaded not guilty in the case and is being held without bail in the Tioga County Jail.
