The Republican candidate for Broome County District Attorney still is not conceding defeat six weeks after the election with another declaration that the Libertarian party candidate won the majority of the votes.

Acting Supreme Court Justice, Chemung County Judge Richard Rich Junior December 17 dismissed a request by Paul Battisti for a hand recount saying there had been no evidence to show legal cause for a recount, ruling Michael Korchak can become the next Broome D.A..

Battisti’s Attorney says the camp is reviewing its appellate rights.

Attorney John Ciampoli released a statement following the ruling saying Broome County may never really know who won the election.

At the conclusion of the count of paper and affidavit ballots, Korchak had beaten Battisti by 55 votes.

Ciampoli says Judge Rich’s ruling was only based on an audit that verifies the voting machines were accurately reading the colored-in ovals while a hand count would confirm voter intent.

Meanwhile, the third candidate in the race, Democrat Debra Gelson again congratulated Korchak on his victory.
