Binghamton Woman Pleads Guilty to Criminal Sex Act With a Child
A 34-year-old Binghamton woman faces ten years in prison after pleading guilty to felony criminal sex act for engaging in sexual conduct with a girl under the age of 14.
Heather Kasmarcik and 36-year-old Derrick Cervini had been indicted in November on 18 sex abuse counts, accused of raping and abusing two boys and one girl between June of 2014 and June of 2016.
The pair was arrested by New York State Police in October of 2018 and charged with criminal sexual act. The Broome County District Attorney’s Office Special Victims Bureau later added charges.
Cervini’s indictment listed charges of felony predatory sexual assault against a child, five felony counts of criminal sexual act, two counts of felony rape, two felony counts of use of a child in a sexual performance, felony course of conduct against a child, felony sexual abuse, felony assault and five misdemeanor counts of endangering the welfare of a child.
Kasmarcik was also indicted for felony predatory sexual assault against a child, four felony counts of criminal sex act and rape and two misdemeanor counts of endangering the welfare of a child.
Again, she pleaded guilty this week to felony criminal sexual act.
Kasmarcik is to be sentenced in May and also is expected to be given 20 years parole in addition to a ten year prison term.
