State police say a 47-year-old man was arrested after a trooper observed him driving recklessly in a convenience store parking lot in the town of Kirkwood.

Authorities say Cesar Rodriguez of Vestal was charged with felony driving while intoxicated following the incident.

Investigators say the trooper took action when he saw Rodriguez driving a pickup truck in the lot of a Mirabito store on Upper Court Street.

Police say Rodriguez refused to submit to a breath test to determine his blood alcohol content.

Officials say the charge is a felony because Rodriguez had another DWI conviction over the past decade.

Rodriguez was ordered to appear in Kirkwood town court on August 20.
