A woman has been indicted by a Broome County grand jury after she allegedly was seen drinking a beer at an Arby's restaurant drive-thru while her two-year-old child was in the car.

According to the district attorney's office, 30-year-old Rebecca Shoemaker of Binghamton was named in a three-count indictment handed up Wednesday.

State police arrested Shoemaker after a May 9 incident at the Arby's restaurant on Upper Front Street in the Town of Chenango.

Investigators have said Shoemaker would not submit to a breath test to determine her blood alcohol content.

Shoemaker was indicted for aggravated driving while intoxicated with a child in a vehicle, a felony. She also was indicted on a misdemeanor DWI count and driving a vehicle with .08 percent of alcohol in her blood.
