Warrant Mistake Sinks Child Porn Charges

A Chenango County man may no longer have child pornography charges filed against him due to a mistake on an arrest warrant.

The New York State Court of Appeals has invalidated the warrant against John Gavazzi of Greene since a New York State Police officer entered 'local criminal court, town of Broome, Broome County.'

Of course, there is no town of Broome in Broome County. There is a town of Broome in Schoharie County.

While one justice said the mistake was just a clerical error with no impact on the case, the other justices disagreed saying the warrant could not be accepted in a trial since it  the jurisdiction issuing the warrant could not be clearly proven.
