Binghamton man is charged with attempted criminal obstruction of breathing for allegedly using a belt to try to strangle his wife during a fight.

Broome County Sheriff’s officials say Kevin Paiz-Figueroa got into a dispute with his wife yesterday when she accused him of marital infidelity.

Paiz-Figueroa is accused of kicking his wife, grabbing her from behind and attempting to choke her before wrapping the belt around her neck.

She managed to fight back and called 911.

The man drove away but was stopped by the Deputy responding to the scene on Castle Creek Road.

Deputies say the dispute happened while the couple’s baby was in a nearby crib.

Authorities say they also found Paiz-Figueroa is not a citizen and is in the U.S. illegally. He’s being held in the Broome County Jail without bail and is awaiting deportation proceedings.

In addition to attempted criminal obstruction of breathing, he’s charged with harassment and endangering the welfare of a child.
