A lawsuit claiming Binghamton's Mayor tried to use his position to influence a case involving assault allegations against his girlfriend is being moved into the ‘discovery’ stage in New York State Supreme Court.

Mayor Richard David’s lawyer had filed a motion seeking dismissal of the case brought by Daisy Dawson of Afton, who alleged David contacted her current, his former employer, WBNG TV in attempt to have her bosses apply pressure for her to drop the assault case.

Dawson claims David’s girlfriend, Ericak Abdu-Shahid, also known as Erica Aminalee, hit her in the head with a glass early New Year’s morning at a Downtown bar for no reason.

David’s lawyer argued the alleged action by the Mayor, “whether true or not” didn’t impact her position or livelihood.

Judge Ferris Lebous did not advance the case to trial but did not throw the lawsuit out and moved to get statements from witnesses and look at new evidence.

David’s attorney is expected to file another motion to dismiss.
