Southern Tier and Central, New York factions both for and against fracking are applauding the announcement that the New York State Court of Appeals will review the case against the Towns of Dryden and Middlefield. Those towns both banned hydraulic fracture drilling for natural gas within their borders, citing Home Rule.

The towns had been sued by members of the gas industry as well as landowners involved in the natural gas play debate.

Both the municipalities' supporters and the pro-drilling side of the argument say they are optimistic the judges will rule in their favor.

The anti-drill side had won victories in a couple other court decisions.

The next decision by the high court could be handed down by next spring.
