An Appellate Division of the New York State Supreme Court has ruled that the Town of  Tyre Board failed to meet New York State Environmental Impact regulations in moving ahead the development proposal for the Lago Resort in the Finger Lakes town.

Several residents of the town have opposed the development, saying it will damage the rural nature of the community with a cluster of buildings and increased traffic.

The award of the license recommendation to Lago last year sparked very vocal protest from bidders in Broome and Tioga Counties who said the winning development bid, just off the New York State Thruway, was not really in the Southern Tier. The Governor agreed and urged the Gaming Commission to open bidding for a final, fourth, casino license.

That bidding closed in the afternoon of July 6 with Tioga Downs the only applicant getting their proposal in before the deadline.

A legal team for Lago says the ruling from the Appellate Division, Fourth Division of the State Supreme Court does not affect the ability of the development to move forward.

So far, the state has only recommended the award of licenses to three developers and the licenses have not actually been granted. The Gaming Commission is currently reviewing Tioga Downs’ proposal and has not recommended the award of a license at this time.
