New York Settles With a Woman Injured in Whitney Point
A Virginia U.S. Marine Corps veteran is to be paid over $1.5 million after being injured by a New York State Police car while she was riding a bicycle in Whitney Point almost six years ago.
Retired Major Mary-Margaret Smith suffered head injuries when she was hit shortly before 9:42 a.m. July 5, 2010 in the area of Liberty and Collins Streets.
During Court proceedings in 2013 it was determined that the trooper turned onto Liberty Street at a sharp angle, hitting Smith and throwing her from her bicycle into the squad car windshield. The ruling was affirmed in 2014 but a second trial had been scheduled for earlier this year to determine the extent of the woman’s injuries before the state decided to settle the claim.
Smith’s attorney says a settlement with New York State of $1.6 million was approved by the comptroller’s office.
