The driver of a flat-bed tractor trailer hauling stone slabs that was one of the first vehicles involved in crashes involving ten vehicles on Route 17 East in Binghamton August 25 is ticketed for having inadequate brakes.  But Broome County officials say that was not the actual cause of the crashes that sent ten people to the hospital, four with broken bones.

74 year old Allen Kirkpatrick of Wyalusing was ticketed for operating an out of service vehicle with inadequate brakes.

The Wyalusing Transit Incorporated truck had been cited in July for damaged tie-downs after inspectors in April said the tractor trailer could not be operated without proper load securement.

The Binghamton Press and Sun Bulletin reports also that the driver of the same truck had been cited last September for operating without rest beyond the eight hour limit but the records did not identify the driver as Kirkpatrick.

The investigation is continuing.

The 4:20 p.m. crash closed the eastbound lanes for about five hours.
