A Johnson City man will not be released early from prison after an attempt to have his manslaughter conviction overturned failed.

52 year old William Kenyon was convicted in the 2009 death of his girlfriend.  46 year old Kelly Westcott's body was found in her Floral Avenue, Johnson City apartment.  Her cause of death had been listed as asphyxiation.

Kenyon was sentenced to 25 years to life in prison as a persistent felony offender.

Kenyon's lawyer argued before the state Appellate Division, Third Department that statements to police should have been disregarded, that there was insufficient evidence and that Kenyon at the time didn't have effective representation.

The court disagreed and rejected the appeal.
