In spite of a plea from his father, New York State Senator Thomas Libous of Binghamton, for no jail time, federal prosecutors are recommending 37 year old Matthew Libous be sent to prison for underreporting his income, failing to fully repay the IRS and tampering with a drug test urine sample.

U.S. Attorney Preet Bharara’s office has asked U.S. District Judge Vincent Briccetti to impose a sentence of two and three quarters years to almost three and a half years in prison for the younger Libous when he is sentenced May 18.

Senator Libous, the Deputy Majority Leader of the state senate, recently sent a letter to the judge urging that Matthew Libous be spared a jail sentence so he could spend time with the Binghamton Republican in his final days.

The Senator told the judge that he is dying and needs his son by his side.

Senator Libous, himself, is due in court in July to face a charge that he lied to the FBI about allegedly using his influence to get Matthew a job at a Westchester County law firm.
