The drama strikes early in Cal Harris’ third murder trial for the disappearance of his wife in 2001.

Just as opening statements were getting started in Schoharie County, the former Tioga County car dealer’s defense called for a mistrial.

The team argued Tioga County district Attorney Kirk Martin’s opening statements claiming Harris was a control freak and his last act of control after Michele said she wanted a divorce was to kill her, overstepped his bounds in addressing the jury.

Schohara County Judge George Bartlett rejected the motion.

Proceedings resume February 9.

Michele Harris was last seen leaving her job at an Owego bar overnight September 11, 2001.

Her body has never been found and there has been no murder weapon produced.

Cal Harris had been convicted of murder twice with both verdicts being overturned on appeal.
