The New York State Appellate Division could begin hearing arguments this week in the latest murder trial actions for former Tioga County businessman, Cal Harris.

Harris' attorneys are appealing for a change of venue for the man's third trial.

Harris had twice been convicted in Tioga County of murder the disappearance of estranged wife, Michele.  Harris' defense team says the case is so well known in Tioga County, it would not be possible to seat an impartial jury there.

The appeal is expected to delay the third trial, which had tentatively been scheduled to start October 7.

Michele Harris disappeared overnight on September 11, 2001.  Her body has never been found.

Her estranged husband was first convicted in 2007.  That decision and the next one in 2009 were overturned on appeal due to errors in the trials and investigation.
